Terms of Service

1. Who we are

ScanMy ("ScanMy", "we", "us", "our") is operated by Horizon Digital Group LLC, a Florida limited liability company and the seller of the services described on this site. By creating an account or using the ScanMy platform, smart QR signs, or related services (collectively, the "Service"), you ("you", "user") enter into a binding agreement with Horizon Digital Group LLC under these Terms of Service.

2. Acceptance

By accessing, signing up for, or continuing to use the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. You must be of legal age in your jurisdiction to enter into this agreement.

3. The Service

ScanMy provides smart QR-powered property signs and a web platform that lets users activate signs, create and manage property listings, and share those listings publicly. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time, and we may modify or discontinue features at any time.

4. Your account and content

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date. You are responsible for the legality, accuracy, and content of every listing you publish. You grant us a limited license to host, store, and display your content solely to provide the Service.

5. Acceptable use

You must not, and must not allow others to:

• use the Service in violation of any law or third-party right;
• publish fraudulent, misleading, infringing, harassing, or unlawful listings;
• send spam or unsolicited messages through the Service;
• upload malware, probe, scan, or otherwise interfere with the security or integrity of the Service;
• scrape, reverse engineer, or attempt to circumvent any technical or usage limits;
• resell or redistribute the Service without our written consent.

6. Intellectual property

The Service, including the ScanMy software, sign hardware designs, branding, and documentation, is owned by Horizon Digital Group LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have subscribed to. All other rights are reserved.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions renew automatically each billing period until cancelled. Plan limits (such as the number of active listings) are enforced server-side. Failed payments may pause your active listings until payment is restored. Pricing, taxes, billing frequency, cancellation, and refund mechanics are also governed by Paddle's Buyer Terms. 8. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your content after a reasonable period.

9. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for any indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnity

You agree to indemnify and hold Horizon Digital Group LLC harmless from any claim or demand arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Horizon Digital Group LLC is established (State of Florida, USA), without regard to its conflict of law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute arising under these Terms, except where prohibited by mandatory local law.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. IDX / MLS listing data

Real estate listings on tenant-branded subdomains are provided in part through the Internet Data Exchange (IDX) program of Stellar MLS, distributed via MLS GRID. All such listing content is copyrighted by the originating Multiple Listing Service and/or the listing brokerage and is licensed for personal, non-commercial consumer use only, solely to identify prospective properties consumers may be interested in purchasing or renting.

You expressly agree NOT to: (a) scrape, crawl, harvest, frame, mirror, or otherwise extract data from this site by automated means; (b) redistribute, resell, sublicense, or republish IDX data in any form; (c) use the data to train, fine-tune, or evaluate any machine-learning or AI model; or (d) circumvent any technical access controls. Violations may result in immediate account termination and civil and criminal liability under the Computer Fraud and Abuse Act, the Copyright Act, and applicable state laws.
